Air Quality Permit Applications



Delaware state law requires air quality permits for equipment which has the potential to discharge air contaminants into the atmosphere. State regulations (7 DE Admin. Code, 1102) establish permitting procedures and requirements.

The Division of Air Quality is working with the regulated community on a proposal to increase fees for Natural Minor (Regulation 1102) permits. Learn More

The Division of Air Quality suggests that applicants take advantage of a pre-application review process to ensure that final applications are both administratively and technically complete.

Applications should be mailed to the Division of Air Quality, along with required permit fees. All checks should be made payable to: State of Delaware.

First time applicants must complete an Environmental Permit Application Background Statement. Operators of stationary generators must register their equipment with the Division of Air Quality, regardless of whether that equipment requires a permit to operate. Please submit a separate information form for each generator. There is no fee for this notification form.

Other Permitting Programs

Stack Parameter Information

The Division of Air Quality is updating information about where and how permitted facilities release emissions. The updated stack parameter information will help engineers make better use of spatial analysis tools to conduct modeling and solve problems. Permit-holders may use the Modeling Input Form and the Stack Coordinate Tutorial to collect and report data on their emissions and stacks.

Title V: Major Air Sources

Title V is an air pollution control program, based on federal law, designed to standardize air quality permits and the permitting process for major sources of air emissions across the country.

Smaller Sources of Air Pollution

Smaller sources of air pollution, known as “Area Sources,” are smaller activities by businesses or facilities that, when measured across a group of sites, can accumulate to large amounts of pollution impacting Delaware’s air quality.

Vapor Recovery Program

The Division of Air Quality partners with the Division of Waste and Hazardous Substances on the Vapor Recovery (VR) program which helps ensure the safe operation of vapor recovery systems at gasoline dispensing facilities. The Tanks Compliance Branch offers information and applications for Stage I and Stage II Vapor Recovery Permits.
