2026 Class III Permit Modification

The proposed modification would update the facility’s existing Resource Conservation and Recovery Act (RCRA) Permit (HW31B04), which governs site-wide corrective action and post-closure care.

Specifically, the modification would update the Post-Closure Care Plan for four former surface impoundments (Solid Waste Management Units 6A, 6B, 6C and 6D) to address the remedial activities proposed for Phase 1 of the project.

The Phase 1 activities include asphalt capping as part of the presumptive remedy selected by DNREC in its 2021 Final Decision and Response to Comments.
