On Nov. 22, 2024, DNREC Secretary Shawn M. Garvin approved authorizing a temporary emergency variance under 7 Del. C. § 6012 to Winchelsea LLC. providing relief from potential occupancy delays via temporary holding tank authorization.
The 60-day temporary emergency variance provides Winchelsea immediate authorization to operate a temporary holding tank system for storage of domestic wastewater generated by up to ten dwellings in the Winchelsea Subdivision in Middletown until a delayed sewer connection can be resolved.
It is anticipated that the sewer connection will be completed prior to the end of December 2024.
Operation of the temporary holding tank system is limited to flow from up to ten dwellings and subject to the conditions set forth in the Temporary Emergency Variance Authorization Letter.
The conditions outlined in the Department’s Temporary Emergency Variance Authorization Letter will limit any potential impacts to the environment.
