This office has under consideration the application of:

Kent County Levy Court (Kent County) has requested renewal of their existing permit for the agricultural utilization of Class B biosolids under Part III, B., of the Guidance and Regulations Governing the Land Treatment of Wastes. The permitted application site consists of 148 acres of land, of which approximately 119 acres is suitable for land application. The site is located on the east side of Carpenter Bridge Road (Road #35) approximately 1 mile southwest of the Town of Frederica (tax parcel number SM-00-140.00-01-76.00-000). Class B biosolids generated at the Kent County Wastewater Treatment Facility may be applied to the permitted application site in accordance with the land application permit.

Prior to land application, the biosolids are required to undergo periodic analysis for a list of specific parameters including nutrient content and metals. Biosolids are required to be delivered to the land application site in accordance with a valid waste transporters permit and the material must be land applied at an agronomic rate.

A public hearing on the above application will NOT be held unless the Secretary of the Department of Natural Resources and Environmental Control (DNREC) determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 30 days from this notice, ending at 4:30 p.m. on October 16, 2026. A public hearing request shall be deemed meritorious if it exhibits familiarity with the application and provides a reasoned statement of the action’s probable impact.
