The Department of Natural Resources and Environmental Control (DNREC), Division of Waste and Hazardous Substances (WHS) will conduct a public hearing on Tuesday, December 1, 2026, beginning at 6:00 p.m. to consider comments from the public on the revised proposed amendments to 7 DE Admin. Code: 1301, “Regulations Governing Solid Waste” (Docket #2025-R-WHS-0016). The initial proposed amendments were published in the December 2025 Delaware Register of Regulations, and a hearing was held on January 6, 2026. As a result of public comments received, the Department is revising the proposed amendments.  In accordance with 29 Del.C. § 10118(c), this public hearing will focus on revisions to the proposed amendments that the Department determined were necessary based on its review.

The Division of WHS proposes to make revisions that include: General updates to formatting, phrasing, style, and punctuation; Additions, deletions, updates, and relocation of definitions; Realignment of the application submission requirements between activity types; Mirroring of applicable language and clarifications for existing language for Municipal Solid Waste Landfills, Industrial Waste Landfills, Resource Recovery Facilities, and Transfer Stations; Clarification and updates for Solid Waste Transporters, Infectious Waste Facility, Compost Facility, and Recycling Facility requirements.
