The initial proposed amendments to the Regulations Governing Solid Waste (7 DE Admin. Code: 1301) were published in the December 2025 edition of the Delaware Register of Regulations. A public hearing was held on Jan. 6, 2026.

As a result of public comments received, the Department is revising the proposed amendments. In accordance with 29 Del.C. § 10118(c), this public hearing will focus on revisions to the proposed amendments that the Department determined were necessary based on its review.

The proposed revisions include:

  • General updates to formatting, phrasing, style and punctuation.
  • Additions, deletions, updates and relocation of definitions.
  • Realignment of the application submission requirements between activity types.
  • Mirroring of applicable language and clarifications for existing language for Municipal Solid Waste Landfills, Industrial Waste Landfills, Resource Recovery Facilities and Transfer Stations.
  • Clarification and updates for Solid Waste Transporters, Infectious Waste Facility, Compost Facility and Recycling Facility requirements.

The revised proposed amendments may be inspected online starting Nov. 1, 2026, in the Delaware Register of Regulations or, in-person, by appointment only, by contacting Alison Kiliszek at Alison.Kiliszek@delaware.gov or 302-739-9403.

The Department will accept public comment through Dec. 16, 2026. Comments will be accepted in written form via email to DNRECHearingComments@delaware.gov, using the online form at de.gov/dnreccomments, or by U.S. mail to the address on this page.
