This office has under consideration the application of:
The Town of Ocean City Wastewater Department, Maryland (the Town of Ocean City) has a distribution and marketing (DM) permit which authorizes the distribution and marketing of biosolids throughout the State of Delaware as a lime stabilized and heat pasteurized fertilizer product. The Town of Ocean City’s biosolids are generated in Ocean City Maryland. To assure compliance with State and Federal regulatory requirements, including requirements for “Class A” “Exceptional Quality” biosolids products, the finished product is sampled for specific bacterial, chemical, and nutrient parameters prior to distribution. In accordance with The Town of Ocean City’s DM permit, biosolids may be utilized as soil amendment for agricultural, horticultural, silvicultural or other soil reclamation activities where a liming amendment may be required as indicated by a soil test and in accordance with approved product labels.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 30 days from this notice, ending at 4:30 p.m. on March 20, 2026. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
