This office has under consideration the applications of:

The Wetlands and Waterways Section of the Delaware Department of Natural Resources and Environmental Control (DNREC) proposes to establish General Permit No. 1 – Floating Docks or Boat Lifts on Private or Public Subaqueous Lands.

This proposed General Permit would authorize the installation of boat lifts with up to six (6) associated pilings or floating personal watercraft (PWC) docks located in tidal waters of the State of Delaware, on either private or public subaqueous lands, provided all eligibility criteria, conditions, and applicable regulatory requirements are met.

The purpose of this General Permit is to streamline the authorization of minor, non-commercial recreational water-dependent structures that are anticipated to result in minimal individual and cumulative environmental impacts, while maintaining compliance with applicable state laws and regulations administered by DNREC.

All activities authorized under this General Permit would remain subject to applicable environmental review requirements and any additional approvals, leases, or authorizations that may be required from DNREC or other local, state, or federal agencies.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 20 days from this notice. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
