Draft Permit

This office has under consideration the application of:

Sussex County Council (Sussex County) has requested a permit for the agricultural utilization of Class B biosolids under Part III, B., of the Guidance and Regulations Governing the Land Treatment of Wastes. The proposed application site is an 85-acre parcel of land located approximately 6 miles southeast of Milford, known as the James Wells Farm (tax parcel number 2-30-14.00-192.00). Recently, the City of Rehoboth Beach terminated their agricultural utilization permit and ceased land applying biosolids onto the James Wells Farm. Sussex County requested the transfer of agricultural utilization permit to Sussex County for the land application of Class B biosolids generated at their Inland Bays Regional Wastewater Facility. Prior to land application, the biosolids are required to undergo periodic analysis for a list of specific parameters including nutrient content and metals. Biosolid will be required to be delivered to the land application site in accordance with a valid waste transporters permit where the material would be required to be land applied at an agronomic rate.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 15 days from this notice, ending at 4:30 p.m. on November 1st, 2025. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
