The Department is issuing a public notice on the Final Damage Assessment and Restoration Plan (DARP) for the Fox Point Park. The DARP will resolve natural resource damages, per the Settlement Agreement, related to the Fox Point State Park (Phase I and Phase II) site located in Wilmington. The Phase II site is comprised of two operable units. Phase I and Phase II Operable Unit 1 (OU-1) includes 60 acres in what is now known as Fox Point Park.
Phase II Operable Unit 2 (OU-2) includes subaqueous lands and extends east of the shoreline of OU-1, covers approximately 203 acres and includes the Fox Point Cove. Remedial actions were completed in the upland portions of the Site in 1995 (Phase I) and 2008/2009 (Phase II OU-1). No remedial actions were necessary for Phase II OU-2. Key restoration objectives will include wetland restoration and construction of a living shoreline.
