Notice has been given that:

James T. Vaughn Correctional Center, requests temporary permits to construct and operate six MQ Power 62kW (95.2HP) diesel fired portable generators at their facility located at 1181 Paddock Road, Smyrna, New Castle County. The engines used in the six generator sets comply with U. S. EPA regulations under the provisions of 40 CFR 1039, Non-Road Tier 4 emissions limits. The six portable generators combined will be permitted to emit 0.16 tons per year of NOX, 0.31 tons per year of CO, 0.009 tons per year of PMTotal, 0.04 tons per year of HC, and 1.08 tons per year of SOX by:

  • Permit: APC-2026/0012-CONSTRUCTION/OPERATION(Temporary,
  • Permit: APC-2026/0013-CONSTRUCTION/OPERATION(Temporary),
  • Permit: APC-2026/0014-CONSTRUCTION/OPERATION(Temporary,
  • Permit: APC-2026/0015-CONSTRUCTION/OPERATION(Temporary), and
  • Permit: APC-2026/0016-CONSTRUCTION/OPERATION (Temporary).

Emissions from the six temporary portable generators will also be restricted to 2,160 hours of operation for a period to not exceed 90 days. Emissions from the six temporary portable generators will be included with facility wide emissions reporting as required by the facility’s existing Synthetic Minor Permit (Permit: APC-2017/0062- OPERATION(NOx RACT)(NSPS)(SM)).

A public hearing on any of the above applications will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application within 15 days from the date of this notice, ending September 8, 2025. A request for a hearing shall be in writing. The request must also show a familiarity with the application and a reasoned statement of the permit’s probable impact.
