Draft/Proposed Permit

Notice is hereby given that Ameresco Delaware Energy LLC and the Delaware Solid Waste Authority having a facility at 29086 Landfill Lane, Georgetown, Delaware, have requested a federally enforceable 7 DE Admin. Code 1102 construction permit (Permit: APC-2025/0035-CONSTRUCTION (NSPS)(MACT)(MNSR)(FE)) for the installation of two (2) General Electric Jenbacher Model JGS 320GS-L.L landfill gas generators (one megawatt each). These landfill gas generators will replace Landfill Gas Generators 1 and 2 which have been removed from the facility. The generator emissions will remain unchanged and each unit will be permitted to emit 8.5 tons per year (TPY) of NOX, 42.4 TPY of CO, 2.4 TPY of PM10, 2.4 TPY of PM2.5, 10.16 TPY of SOX, 3.6 TPY of NMOC, and 11.4 TPY of HAPs by Permit: APC-2025/0035-CONSTRUCTION (NSPS)(MACT)(MNSR)(FE).

Upon completion of construction, the Department will incorporate the operating conditions and limits of the 7 DE Admin. Code 1102 Construction permit into the facility’s existing Title V permit (Permit: AQM-005/00258-Renewal 1) via an Administrative Amendment.

The application, the “draft/proposed” construction permit, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft/proposed” permit may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. The “draft/proposed” construction permit is being submitted to EPA for concurrent processing. If there are no significant comments, the “draft/proposed” construction permit will be issued as a final permit after the expiration of the EPA review period.

A public hearing on the above application will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application within 30 days from the date of this notice, ending February 18, 2025. A request for a hearing shall be in writing. The request must also show a familiarity with the application and a reasoned statement of the permit’s probable impact.
