The Department of Natural Resources and Environmental Control (DNREC) Division of Watershed Stewardship Sediment and Stormwater Program has revised the Delaware National Pollutant Discharge Elimination System (NPDES) Construction General Permit (CGP). The CGP was first authorized as a stand-alone permit in March 2021 with an effective period of five years and is to be reauthorized. This document supports 7 DE Admin. Code 7201 Regulations Governing the Control of Water Pollution, Part 2 – Special Conditions for Stormwater Discharges From Construction Activities.
Proposed changes to the Delaware NPDES CGP include updates to clarify NOI and NOT requirements and management procedures and on-site document requirements, update URLs and terminology, aligned natural buffer, dust control, soil stabilization, inlet protection, sediment basin design, and dewatering controls with regulatory standards; reorganize pollution prevention measures to align with the 2022 federal CGP; update waste management and dumpster-emptying practices; define dewatering; and add an allowance to limit new permit coverage for permittees failing to comply

A public hearing on the revised permit will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the permit is received within 30 days from this notice. A public hearing request shall be in writing, show familiarity with the permit, and provide a reasoned statement of the revised permit’s probable impact.
