LBG Homes LLC (Lisa Horsey), has applied for a Formal Waiver per Section 5.6 of the Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems (Regulations). This request is to seek relief from Section 5.3.4.1 of the Regulations regarding minimum isolation distances established in Exhibit C when designing, locating, repairing, replacing and installing on-site wastewater treatment and disposal systems. More specifically, the Formal Waiver is required due to the inability to maintain the minimum isolation distance of 50 (fifty) feet between the proposed Permanent Holding Tank and domestic wells located at 8537 and 8547 Hearns Pond Road, Seaford, DE 19973. This request is to permit a 2800-gallon permanent holding tank which has been designed to accommodate 360 gallons of wastewater flow per day. The system will serve a three-bedroom residential single-family home. The property is located at 8537 Hearns Pond Road, Seaford, DE 19973, Sussex County, Tax Map #331-03.00-92.00.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received by December 18, 2023, at 4:30 p.m. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
