Project Description: 120 Hay Road, LLC has applied for reissuance of its National Pollutant Discharge Elimination System (NPDES) Permit No. DE0050857 (State Number WPCC 3110G/79) to discharge stormwater to the Delaware River. 120 Hay Road, LLC purchased the property on 3/30/2023 from IKO Productions, Inc. (a former shingle manufacturing facility). The site is now vacant, with all buildings demolished and aboveground storage tanks removed. The site is now used for general warehousing and the outside storage of trucks, trailers, and construction materials. Based on a preliminary staff review and application of lawful standards and regulations, the Department proposes to re-issue this permit, subject to certain effluent limitations and conditions.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 30 days from this notice, ending at 4:30 p.m. on July 24, 2026. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
