The Department of Natural Resources and Environmental Control (DNREC) Remediation Section (RS) invites public comment on an amended proposal to clean-up The Borden Chemical Co Smyrna Site (DE-0022) (Site) located at 4474 Wheatley’s Pond Road in Clayton. The December 2024 Final Plan of Remedial Action is being amended based on additional investigation that indicated that site soil does not present a potential human health risk. Therefore, the Site will not be restricted to non-residential uses. The Final Plan is being amended to remove the use restriction. The Site is approximately 5.81 acres and is developed with a 1,376 square feet single vacant warehouse building on the southwest corner. The remainder of the Site consists of various concrete building foundations, a former in-ground truck scale, and grassy/wooded land. The Site historically operated as an agricultural chemical supplier.
Borden Chemical Co Smyrna Site will be subject to the following key remedial actions: submittal of a Long-Term Stewardship (LTS) Work Plan which specifies the groundwater monitoring requirements and schedule to be followed in order to monitor the groundwater contaminants; recording of an Environmental Covenant restricting the groundwater withdrawal and compliance with the LTS Plan.
