Non-Discrimination Policy

Pursuant to the Hazardous Substance Cleanup Act (HSCA), 7 Del. C. Chapter 91, §9126, the Department of Natural Resources and Environmental Control (DNREC) is required to issue a public notice within twenty days after entering into negotiations for a Brownfield Development Agreement (BDA). A BDA is an agreement between DNREC and a Brownfield developer with respect to a Certified Brownfield Site that sets forth a scope of work and schedule of remedial activities during the development of the Site.

DNREC’s Remediation Section (DNREC-RS) negotiated a BDA with Community Education Building Corp., a non-profit corporation organized under the laws of the State of Delaware (“CEB” or “Joined Party”), and PS#5, LLC, a limited liability company organized under the laws of the State of Delaware (“PS#5”), regarding the Clifford Brown Walk & E. 12th Street Site (Site), located at 315 E. 12th St., 1201 Wilson Street, 1227-1249 Wilson Street, 1226-1248 Wilson Street, 300-310 E. 13th Street, and 1223-1231 Clifford Brown Walk, Wilmington, Delaware. Identified by New Castle County as tax parcel numbers 26-029.30-250, 26-029.30-249, 26-029.30-248, 26-029.30-247, 26-029.30-246, 26-029.30-245, 26- 029.30-244, 26-029.30-243, 26-029.30-242, 26-029.30-241, 26-029.30-240, 26-029.30-239, 26- 029.30-238, 26-029.30-237, 26-029.30-236, 26-029.30-235, 26-029.30-234, 26-029.30-233, 236.10-041, 26-036.10-042, 26-036.10-043, 26-036.10-044, 26-036,10-040, 26-036.10-041, 26.029.30-221, 26-029.30-222, 26-029.30-223, 26-029.30-224, 26-029.30-225, 26-029.30-226, 26-029.30-227, 26-029.30-228, 26-029.30-229, 26-029.30-230, 26-029.30-231, 36-029.30-232, and 26-029.30-251, the Site may have had a release of hazardous substances as a result of historical activities on site.
