The Secretary of the Department of Natural Resources and Environmental Control (DNREC) has made a decision regarding the request for a Coastal Zone Act (CZA) status decision (Project CZA-446SD) from Atlantic Concrete Company, Inc. (“Atlantic Concrete”). On March 10, 2025, a status decision request was submitted on behalf of Atlantic Concrete to determine if a CZA permit is required to conduct residual concrete management activities and the handling of waste and byproducts on a parcel acquired in 2001 adjacent to 16762 Old Orchard Rd., Lewes, Sussex County, DE. In consideration of the status decision application, public comments received, previous status decisions, and in consultation with legal counsel, the Secretary has determined that a permit will be required pursuant to 7 Del. C. Chapter 70 and 7 DE Admin. Code 101 Regulations Governing Delaware’s Coastal Zone.
Pursuant to 7 Del. C. § 7007(b), anyone wishing to appeal this decision to the State Coastal Zone Industrial Control Board (CZICB) must do so by end of day on May 23, 2025.
