Pursuant to the Federal requirements of the Coastal Zone Management Act (CZMA) at 16 USC § 1455(e) and 15 C.F.R. Part 923, Subpart H, the Delaware Department of Natural Resources and Environmental Control (DNREC), Division of Climate, Coastal and Energy (DCCE) has submitted to the National Oceanic and Atmospheric Administration (NOAA) Office for Coastal Management (OCM) a Program Change to the federally approved Delaware Coastal Management Program (DCMP). This Program Change incorporates minor substantive updates and meet each of NOAA’s decision criteria under 15 CFR § 923.84.
The proposed changes include notification of the incorporation of a previously approved geographic location description, clarifying language in DCMP’s policy document introductory sections, minor updates to DCMP’s procedures and administration, corrections to typographical errors in spelling and citations, updated enforceable mechanism citations which do not alter DCMP policies, and revisions to enforceable policies resulting from updated enforceable mechanisms.
The DCMP seeks to reflect within its policies updates to Delaware’s Coastal Zone Act (7 Del. C. Ch. 70), Delaware’s Sediment and Stormwater Regulations (7 Del. Admin. C. 5101), Delaware’s Regulation Governing Beach Protection and the Use of Beaches (7 Del. Admin. C. 5102), and Delaware’s Regulations Governing Underground Injection Control (7 Del. Admin. C. 7102).
The DCMP’s submission (DE-2024-1) is available for viewing on-line at the NOAA OCM Program Change web portal: coast.noaa.gov/czmprogramchange/#/public/home. Public comments may be submitted on-line at the OCM link above.
Comments on the Program Change will be accepted by OCM for 21 days from the date of publication of this notice.
