Notice is hereby given that River Asphalt, LLC dba River Asphalt II having a facility at 36393 Sussex Hwy, Delmar, Delaware, has requested a federally enforceable 7 DE Admin. Code 1102 construction permit (APC-2026/0161-CONSTRUCTION (FE)) for 0.070 TPY VOC, 0.841 TPY NOx, 0.0088 TPY SOx, 0.324 TPY CO, 0.042 TPY PT, 0.042 TPY PM10, and 0.042 TPY PM2.5 for a natural gas fired asphalt cement heater.

River Asphalt, LLC dba River Asphalt II requests a limit for operation hours for the drum dryer and a 300 TPH portable crusher/screener, and to fire the drum dryer and asphalt heater on natural gas only. These limits are necessary to restrict River Asphalt, LLC dba River Asphalt II potential to emit air pollutants, and the limit will be enforceable by the EPA and the state. Upon completion of construction, total permitted emissions from the facility will be 1.99 TPY VOC, 9.42 TPY NOx, 1.80 TPY SOx, 45.71 TPY CO, 0.502 TPY PM10, and 0.502 TPY PM2.5.

Upon completion of construction, the Department will incorporate the operating conditions and limits of the 7 DE Admin. Code 1102 Construction permit into the facility’s existing Synthetic Minor Permit (Permit: APC-2003/0728-OPERATION (Amendment 9)(NSPS)(SM)) via an Administrative Amendment.

The application, the “draft” permit (APC-2026/0161-CONSTRUCTION (FE)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may be reviewed upon request. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending August 14, 2026. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
