Draft Permit
Notice is hereby given that Kent County Levy Court Department of Public Works, Regional Wastewater Treatment Facility, has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2.9, and 12.3 for the construction of a new biosolids dewatering and thermal drying facility, that consists two (2) 14 MMBTU/hr ANDRITZ Model BDS RD 35 natural gas fired belt dryers and associated BioAir Model Qimi CS66+CS612 odor scrubbers, one (1) 27.5 kW (37 bhp) Clarke model JU4H-UFAEA0 diesel fired fire pump and six (6) small natural gas fired make-up air units with a combined maximum heat input of 3.10 MMBTU/hr at 139 Milford Neck Road, Milford, Delaware.
Kent County Levy Court Department of Public Works, Wastewater Treatment Facility requests a limit for the operation of one dryer at a time for a total of 8760 hours/year combined operation for both DRYER-1 and DRYER-2. These limits are necessary to restrict Kent County Levy Court Department of Public Works, Wastewater Treatment Facility potential to emit air pollutants, and the limit will be enforceable by the EPA and the state. Total estimated emissions from the facility are 22.23 TPY of NOX, 42.02 TPY of CO, 1.16 TPY of SOX, 4.67 TPY of PMTotal/10/2.5, 24.68 TPY of VOC, 0.141 TPY HAPs, 0.17 TPY NH3, 0.17 TPY H2S, and 0.01 TPY Hg.
The application, the “draft” permit (APC-2025/0096-CONSTRUCTION (MNSR)(NSPS)(SM)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending May 8, 2026. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
