Application

Notice has been given that:

Bishop-Hastings Funeral Home requests a permit to construct one (1) natural gas-fired Matthews Environmental Solutions Power Pak I Plus (IE43-PPI) Crematory Incinerator at their 19 South Main Street facility in Selbyville Sussex County. The crematory incinerator will be permitted to emit up to 0.687 tons per year (TPY) of PM/PM10/PM2.5, 0.750 TPY of CO, 1.082 TPY of NOX, 0.085 TPY of volatile organic compounds, and 0.307 TPY of SOX by Permit: APC-2026/0163-Construction/Operation. Using information obtained through testing conducted and published by the Environmental Protection Agency (EPA), the Department has estimated and modeled the emission rates of various trace heavy metals and hazardous air pollutants emitted from operation of the unit and determined that the pollutants do not pose a threat to the health and safety of the general public.

Please note that this application will not result in an additional crematory incincerator at the location. The January 26, 2025 legal notice was for a different model that will not be installed and operated.

The application for this permit may be reviewed upon request. The application is posted at de.gov/dnrecnotices. To submit comments, for additional information or for information regarding how you can inspect the application, please contact Jennifer Childears at (302) 739‑9402 or jennifer.childears@delaware.gov.

A public hearing on any of the above applications will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application within 15 days from the date of this notice, ending April 16, 2026. A request for a hearing shall be in writing. The request must also show a familiarity with the application and a reasoned statement of the permit’s probable impact.
