Notice is hereby given that Allan Myers, Delaware, Inc. has submitted an amendment request, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2.9, and 12.3 for an Amendment to increase the lb total particulate per ton hot mix asphalt limit from 0.013 lb/ton HMA to 0.015 lb/ton HMA (based on three standard deviations) and revise a total particulate stack testing condition at 22351 Joseph Road, Georgetown, Delaware.
Allan Myers, Delaware, Inc. previously requested a limit for production of 275,000 tons/year for hot mix asphalt. This limit is necessary to restrict Allan Myers, Delaware, Inc. potential to emit air pollutants, and the limit will be enforceable by the EPA and the state. Total estimated emissions from the facility are 7.61 TPY TOC, 12.18 TPY NOx, 13.87 TPY SOx, 29.30 TPY CO, 3.53 TPY PM2.5, 5.87 TPY PM10, and 12.13 TPY PT.
The application, the “draft” permit (APC-1997/0494-OPERATION (Amendment 22)(MNSR)(NSPS) (SM)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending October 21, 2025. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
