Notice is hereby given that River Asphalt LLC dba River Asphalt II has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2.9, and 12.3 for an amendment at 36393 Sussex Hwy, Delmar, Delaware.
River Asphalt II requests a limit for operation hours for the drum dryer and a 300 TPH portable crusher/screener, to fire the drum dryer and asphalt heater on natural gas only, and to remove the use of Recycled Asphalt Shingles (RAS) from the permit. These limits are necessary to restrict River Asphalt II’s potential to emit air pollutants, and the limits will be enforceable by the EPA and the state. Total permitted emissions from the facility are 9.60 TPY NOx, 46.14 TPY CO, 2.02 TPY THC/TOC, 4.14 TPY PT, 1.86 TPY PM10, 0.043 TPY PM2.5, and 1.80 TPY SOx.
The application, the “draft” permit (APC-2003/0728-OPERATION (Amendment 9)(NSPS)(SM)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending May 27, 2025. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
