Notice is hereby given that DuPont Specialty Products USA, LLC, having a facility at 200 Powder Mill Road in Wilmington, Delaware, has submitted a request for a permit renewal pursuant to 7 DE Admin. Code 1130, Section 7 for operating Permit: AQM-003/00011-Renewal (03). Based on the data and certifications contained in the permit renewal application, the Division of Air Quality concludes that the applicant meets all applicable requirements promulgated by the Environmental Protection Agency (EPA) and the Department of Natural Resources and Environmental Control (DNREC). Therefore, a “draft/proposed” permit renewal has been prepared along with amendments to the relevant underlying 7 DE Admin. Code 1102 permits at the facility. The “draft/proposed” 7 DE Admin. Code 1130 permit renewal and associated underlying 7 DE Admin. Code 1102 permit amendments were performed to ensure the permits accurately reflect the facility’s current operations and emissions profile, to incorporate current state and federal regulatory language and requirements, and to provide additional clarification on the Department’s compliance expectations.
The application, the “draft/proposed” permit renewal (AQM-003/00011), amended “draft/proposed” underlying 7 DE Admin. Code 1102 permits (Permit: APC-1982/0081-OPERATION (Amendment 7) (NOX RACT)(FE); Permit: APC-1982/0082-OPERATION (Amendment 7)(NOX RACT)(FE); Permit: APC-1982/0083-OPERATION (Amendment 6)(NOX RACT)(FE); Permit: APC-1982/0479-OPERATION (Amendment 13)(VOC RACT)(FE); Permit: APC-1984/0579-OPERATION (Amendment 5)(FE); Permit: APC-1992/0436-OPERATION(Amendment 1)(FE); Permit: APC-1997/0460-OPERATION (Amendment 1) (FE); Permit: APC-2007/0098-OPERATION(Amendment 3)(FE); Permit: APC-2010/0066-OPERATION (Amendment 1)(FE); Permit: APC-2017/0147-OPERATION (Amendment 6)(NSPS)(MNSR)(FE)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the “draft/proposed” permit renewal may be reviewed upon request. The “draft/proposed” permits are being submitted to EPA for concurrent processing. If there are no significant comments, the “draft/proposed” permits will be issued as final permits after expiration of the EPA review period.
A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending May 13, 2025. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit renewal’s probable impact.
