Draft/Proposed Permit

Notice is hereby given that DaSTOR, LLC, having a facility at 3 Boulden Circle in New Castle, Delaware, has requested a federally enforceable 7 DE Admin. Code 1102 construction permit (Permit: APC-2027/0017-CONSTRUCTION (NSPS)(PTE)(FE)) for one (1) diesel-fired emergency generator, rated 2,280 kW (3,058 HP). The engine used in this generator set is certified to meet the relevant emission standards of Subpart IIII of 40 CFR Part 60. It will be permitted to emit up to 4.90 tons of nitrogen oxides (NOX), 0.10 tons of carbon monoxide (CO), 0.03 tons of nonmethane hydrocarbons (NMHC), 0.01 tons of sulfur dioxide (SO2), and 0.06 tons of particulate matter (PM/PM10/PM2.5) on a rolling twelve-month basis.

DaSTOR, LLC also requested rolling twelve-month operating hour limitations for its proposed and existing emergency generators. These limits are necessary to restrict DaSTOR, LLC’s potential to emit NOX below the major source threshold. The limits will be enforceable by the EPA and the state. Total permitted emissions from the facility are 24.96 tons of NOX, 0.92 tons of CO, 1.12 tons of NMHC, 0.75 tons of SO2, and 0.17 tons of PM/PM10/PM2.5 on a rolling twelve-month basis.

Upon completion of construction, DaSTOR, LLC will submit a request to incorporate the operating conditions and limits of its active 7 DE Admin. Code 1102 Operation permits into a Facility-Wide Synthetic Minor Permit.

The application, the “draft” permit (Permit: APC-2027/0017-CONSTRUCTION (NSPS)(PTE)(FE)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may be reviewed upon request. The material is posted at de.gov/dnrecnotices. To submit comments, for additional information, or for information regarding how you can inspect the application materials, please contact Mia White at (302) 739-9402 or mia.white@delaware.gov.

A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending November 13, 2026. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
