Notice is hereby given that Ameresco Delaware Energy LLC having a facility at 1119 Willow Grove Rd, Sandtown, Delaware, has submitted a request for a significant permit modification pursuant to 7 DE Admin. Code 1130, Section 7, for operating permit: AQM-001/00247-Renewal (02) Revision (01). Based on the data and certifications contained in the application, the Division of Air Quality concludes that the applicant meets all applicable requirements promulgated by the Environmental Protection Agency (EPA) and the Department of Natural Resources and Environmental Control (DNREC). Therefore a “draft/proposed” significant permit modification has been prepared. This “draft/proposed” significant permit modification increases total sulfur in the landfill gas to 375 ppm as an alternative total sulfur limit to 170 ppmv total sulfur pursuant to 7 DE Admin. Code 1144 Section 5.3. This affects rolling twelve month emissions of SO₂ for all three Emission Units (Emission Unit 1:Engine 1, 2, 3; Emission Unit 2: Engines 4, 5; Emission Unit 3: Temperature Swing Absorption Flare).

The underlying 7 DE Admin. Code 1102 permits will also be updated to reflect this change. Emissions for Engines 1, 2, and 3 under Permit: APC-2005/0146-Operation (Amendment 5)(NSPS)(MACT) (PTE)(FE) will be 24.2 TPY NO_X combined, 40.3 TPY CO per engine, 2.3 TPY total PM per engine, 6.31 TPY SO_X per engine, 3.0 TPY NMOC per engine, and 10.8 TPY HAPs per engine. Emissions for Engines 4 and 5 under Permit: APC-2013/0052-Operation (Amendment 2)(NSPS)(GACT)(MNSR)(FE) and Permit: APC-2013/0053-Operation (Amendment 2)(NSPS)(GACT)(MNSR)(FE) will be 16.99 TPY NO_X combined, 84.88 TPY CO combined, 6.32 TPY NMOC combined, 4.58 TPY PM_2.5 combined, 13.29 TPY SO₂ combined, and 22.78 TPY HAPs combined.

The application, the “draft/proposed” significant permit modification [AQM-001/00247(Renewal 2)(Revision 1)], all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the “draft/proposed” significant permit modification may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. The “draft/proposed” permit renewal is being submitted to EPA for concurrent processing. If there are no significant comments, the “draft/proposed” permit renewal will be issued as a final permit after expiration of the EPA review period.

A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending October 9, 2026. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit renewal’s probable impact.
