Request for Reconsideration of DNREC’s June 16, 2026 Determination as set forth in Secretary’s Order No. 2026-WH-0006

On April 26, 2026, the Department of Natural Resources and Environmental Control (DNREC) issued Secretary’s Order No. 2026-WH-0006, finding AMETEK, Inc., Marshallton Realty Holdings, LLC, and Niche Polymer, LLC (“Respondents”), in violation of the Hazardous Substance Cleanup Act (“HSCA”) and its implementing regulations, specifically, 7 DE Admin. Code 1375. The Order requires Respondents to promptly undertake corrective actions to bring the facility into compliance with HSCA regulations. Pursuant to 7 Del. C. §6005(b)(3), Respondent, Niche Polymer, LLC, has requested an Administrative Hearing for reconsideration of the determination set forth in the aforementioned Secretary’s Order.
