Notice is hereby given that First State Generation LLC Edge Moor Energy Center having a facility at 200 Hay Road in Wilmington, Delaware, has submitted a request for permit renewal pursuant to 7 DE Admin. Code 1130, Section 7 for operating Permit: AQM-003/00007-Renewal (4). Based on the data and certifications contained in the application, the Division of Air Quality concludes that the applicant meets all applicable requirements promulgated by the Environmental Protection Agency (EPA) and the Department of Natural Resources and Environmental Control (DNREC). Therefore a “draft/proposed” permit renewal has been prepared. This “draft/proposed” permit renewal incorporates the applicable requirements for all regulated air pollutants and requires the facility to comply with the terms and conditions of the permit and be liable for all violations of the permit conditions and applicable federal and state rules.
The application, the “draft/proposed” permit renewal Permit: AQM-003/00007-Renewal (4), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the “draft/proposed” permit renewal may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. The underlying 7 DE Admin Code 1102 Permits: APC-83/0824-OPERATION (Amendment 7)(NOX RACT), APC-83/0825-OPERATION(Amendment 7)(NOX RACT), APC-83/0826-OPERATION (AMENDMENT 6)(EOP)(PSD)(NSPS)(NOx RACT), and APC-2015/0026-OPERATION (AMENDMENT 1 (NSPS) will also be amended to include the new requirements that have been incorporated into the Title V permit. Permit: APC-83/0824-OPERATION (Amendment 7)(NOX RACT) includes the following emission limits: 265 TPY NOX, 226.56 TPY SO2, 37.98 TPY PMtotal/PM10/PM2.5, 13.70 TPY VOCs, and 65.01 TPY CO. Permit: APC-83/0825-OPERATION (Amendment 7)(NOX RACT) includes the following emission limits: 483 TPY NOX, 413.25 TPY SO2, 69.28 TPY PMtotal/PM10/PM2.5, 24.98 TPY VOCs, and 118.58 TPY CO. Permit: APC-83/0826-OPERATION (AMENDMENT 6)(EOP)(PSD)(NSPS)(NOx RACT) includes the following emission limits: 1,348 TPY NOX, 4,600 TPY SO2, 1,038.53 TPY PMtotal/PM10/PM2.5, 107.48 TPY VOCs, and 1,641.57 TPY CO. Permit: APC-2015/0026-OPERATION (AMENDMENT 1) (NSPS) includes the following emission limits: 9.47 TPY NOX, 0.99 TPY CO, 0.01 TPY SOX, 0.32 TPY VOC, and 0.09 TPY PMtotal/PM10/PM2.5.
The “draft/proposed” permit renewal is being submitted to EPA for concurrent processing. If there are no significant comments, the “draft/proposed” permit renewal will be issued as a final permit after expiration of the EPA review period.
A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending April 24, 2026. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit renewal’s probable impact.
