Notice is hereby given that Veterans Health Administration having a facility at 1601 Kirkwood Highway, Wilmington, Delaware, has submitted a request for a permit renewal pursuant to 7 DE Admin. Code 1130, Section 7 for operating Permit: AQM-003/00077-Renewal (04). Based on the data and certifications contained in the application, the Division of Air Quality concludes that the applicant meets all applicable requirements promulgated by the Environmental Protection Agency (EPA) and the Department of Natural Resources and Environmental Control (DNREC). Therefore a “draft/proposed” permit renewal has been prepared. This “draft/proposed” permit renewal will allow for the continued operation of the Facility for five years.
The application, the “draft/proposed” permit renewal, Permit: AQM-003/00077-Renewal (05), and all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the “draft/proposed” permit renewal, may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. The “draft/proposed” permit renewal is being submitted to EPA for concurrent processing. If there are no significant comments, the “draft/proposed” permit renewal will be issued as a final permit after expiration of the EPA review period.
The underlying 7 DE Admin. Code 1102 permits must also be amended to reflect updates to the Title V permit. Permit: APC-1979/0481-Operation (Amendment 04), Permit: APC-1979/0482-Operation (Amendment 04), Permit: APC-1979/0483-Operation (Amendment 04), and Permit: APC-1980/0880-Operation (Amendment 02) limit emissions to 1.12 TPY of VOCs, 12.50 TPY of NOX, 6.44 TPY of SOX, 1.02 TPY of PM10/PM2.5, and 8.70 TPY of CO. Permit: APC-2020/0149-Operation (NSPS)(FE)(Amendment 01) limits emissions to the applicable Tier standards outlined in Title 40 CFR Part 89. Permit: APC-2012/0141-Operation (Amendment 01) limits emissions to the applicable Tier standards outlined in Title 40 CFR Part 89. Permit: APC-2007/0079-Operation (Amendment 01) limits emissions to 6.4 grams/kilowatt-hour of NMHC+NOX, 3.5, grams/kilowatt-hour of CO, and 0.20 grams/kilowatt-hour of PM.
A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending January 2, 2026. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit renewal’s probable impact.
