Proximity Malt, a malt generation facility located in Laurel, Delaware, has requested renewal of their existing Agricultural Utilization (AGU) permit. The existing permit authorizes the facility to operate a land treatment system for the agricultural utilization of malting wash water onto lands suitable for land application and crop production. Suitable lands include existing application sites (followed by tax parcel numbers) known as the Powell Farm (432-14.00-14.00), Graham Farm (332-7.00-7.00 and 332-7.00-8.00), Messick East Farm (432-12.00-15.00), Walson East Farm (432-12.00-14.00), Joseph Farm (332-8.00-12.00, 332-8.00-12.01, and 332-8.00-13.00), and Arvey Farm (532-8.00-3.00). Additionally, three new land application sites known as the Messick West Farm (432-12.00-15.00), Walson West/Center Farm (432-12.00-14.00), and the Walson North Farm (432-12.00-14.00) were requested to be added to Proximity Malt’s existing AGU permit. The aforementioned land application farms collectively consist of approximately 550 acres of land located near Laurel, Delaware.

Malting wash water is generated during the malting process. Grains primarily consisting of barely, wheat, and rye are soaked in water. Upon the germination of the grain, the wash water is removed from the malting vessel. The malting wash water can then be beneficially reused as a fertilizer since it contains nutrients, which are essential for agricultural crop production. The AGU permit will require that the malting wash water to be analyzed for a list of specific parameters including nutrient content. Hydraulic load and nutrient content will limit the application volume onto permitted land application sites. The malting wash water will be required to be transported to the aforementioned land application sites in accordance with a valid Delaware Non-Hazardous Liquid Waste Transporters permit.

Notice is hereby given that Proximity Malt has submitted a permit application requesting that their existing agricultural utilization permit for the land treatment of malting wash water at the aforementioned farms be renewed under the Department’s Guidance and Regulations Governing the Land Treatment of Wastes, Part V, Land Treatment of Waste Products which allows for such activity pending public notice.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received withing 30 days from this notice. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
