The Environmental Appeals Board of the State of Delaware (the “Board”) has scheduled a hearing for oral arguments on Initial Motions pursuant to its authority under 7 Del. C. §§ 6007 and 6008 on the consolidated appeals (designated as Appeal No’s. 2021-07, 08, 09 and 10) filed by Jeffrey Richardson, Marie Reed, Karen Cheeseman, Simeon Hahn, and Mujahid Nyahuma (2021-07); The Philadelphia regional Port Authority (2021-08); Greenwich Terminals LLC, et al, (2021-09) and Walter F. Curran (2021-10). The appeal challenges Secretary’s Order No. 2021-W/CCE-0026 dated September 30, 2021.
The hearing will begin at 9:00 a.m. on July 26, 2022 and will be hosted on a virtual hearing platform. The link to this hearing can be found on the EAB website. The parties may be represented by Delaware counsel or appear personally. There will be another hearing for oral arguments on Motions in Limine on September 13, 2022, and a merits hearing scheduled on October 11, 2022 and, if needed, October 25, 2022. More information regarding the scheduling can be found on the EAB website. The Board may affirm, reverse, or remand the decision of the Secretary. Pursuant to 7 Del. C. § 6008(a), the Board may enter into executive session for deliberation.
