Agricultural Utilization Permit Renewal – Kent County Levy Court (Delaware):
Kent County Levy Court, located at 555 S Bay Rd, Dover, DE 19901, has an agricultural utilization (AGU) permit which authorizes the land application of treated biosolids (Class B) generated at the Kent County Regional Resource Recovery Facility onto four farms, located in Kent County Delaware, known as the Kent County Sludge Farm (tax parcel numbers 5-00-14200-01-5500 and 5-00-14200-01-2000), the Blessing Farm (tax parcel numbers 5-00-17200-01-6900 and 5-00-17200-01-3300), the Goldinger Farm (tax parcel number 1-00-03800-01-0200), and the West Farm (tax parcel numbers 5-08-14100-01-0100 and 5-00-14100-01-0300). Prior to land application, the biosolids are required to undergo periodic analysis for a list of specific parameters including nutrient content and metals. Biosolids are required to be delivered to the land application sites in accordance with a valid waste transporters permit and applied as a fertilizer product at agronomic rates. Historically, application under this permit has been infrequent. The land application sites in Kent County’s AGU permit are not normally utilized for biosolids application unless Class A biosolids production is not possible.
Distribution and Marketing Permit – Request for Renewal – Kent County Levy Court (Delaware):
Kent County Levy Court, located at 555 S Bay Rd, Dover, DE 19901, has a distribution and marking (DM) permit which authorizes the application of biosolids, which have been lime stabilized and thermally pasteurized or heat dried, generated at the Kent County Regional Resource Recovery Facility (located near Frederica Delaware – tax parcel number 5-00-14200-01-2000) onto farmland throughout the State of Delaware as a fertilizer and a liming agent. To assure compliance with State and Federal regulatory requirements, including requirements for “Class A” “Exceptional Quality” biosolids products, the finished product is sampled for specific bacterial, chemical, and nutrient parameters prior to distribution. In accordance with the DM permit, the land application of biosolids may be made onto land at a rate to adjust the soil pH as determined by an approved soil test and to provide nutrients for crop growth at an agronomic rate in accordance with a nutrient management plan. The “Kentorganite” product is permitted to be utilized in agricultural settings and on athletic fields, golf courses, roadside grass strips, and other similar grassy areas.
Notice is hereby given that Kent County Levy Court has submitted a permit application requesting that their existing AGU and DM permits be renewed under the Department’s Guidance and Regulations Governing the Land Treatment of Wastes, Part III, B., Regulations Governing the Land Treatment of Sludges and Sludge Products which allows for such activity pending public notice.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received withing 30 days from this notice. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
