Pursuant to 7 Del. C., Chapters 60 and 63, Delaware’s Regulations Governing Hazardous Waste (DRGHW), Diamond State Port Corporation (DSPC) is providing notice of a public meeting regarding a class III permit modification application for the Port of Wilmington Edgemoor facility (former DuPont Edgemoor Resource Conservation and Recovery Act RCRA Facility, U.S. Environmental Protection Agency (EPA) ID No. DED000800284). Facility is located at 4600 Hay Road, Edgemoor, New Castle County, Delaware, 19809.
DSPC is requesting a Class III modification to its existing RCRA permit (HW31B04) pursuant to Section II.G.2(b) of the permit and 7 Del. Admin Code 1302-122.42(c). The permit governs both Site Wide Corrective Action and Post Closure Care. Permit Attachment 2- Post-Closure Care Plan (PCCP) for the RCRA Solid Waste Management Unit (SWMU) 6A, 6B, 6C, and 6D which are four surface impoundments on the facility has been modified to provide Post-Closure Care for the presumptive remedy. The permit modification is limited to the Phase 1 remedial actions, which will include 46% of the facility to be capped with asphalt paving to meet the presumptive remedy at the facility pursuant to the requirements of the 2021 FDRTC, which includes asphalt capping (80% of the facility).
Per the requirements of the RCRA permit, an Excavated Materials Handling and Contingency Plan (EMHCP) has been submitted and approved on 05/12/2026 for implementation during construction, and a Corrective Measures Implementation (CMI) Work Plan was submitted to DNREC for review and was approved on 09/24/2026. Following submittal and approval of the EMHCP and CMI Work Plan, the requirements of the 2021 Final Decision and Response to Comment (FDRTC), require a Design Report along with a Class III Permit Modification Application to be submitted to DNREC. The Design Report and Class III Permit Modification Application was submitted to DNREC for review on 09/28/2026.
A public meeting will be held on Monday, November 16, at 6pm at the Brandywine Fire Hall, located at 1006 Brandywine Blvd, Wilmington, DE 19809.
Attendees will have an opportunity to learn about the proposed RCRA permit modification and ask questions. Formal written comments may be submitted to RS_Public_Comments@delaware.gov before the public comment period closes.
The public comment period will close at 4:30 p.m. on Monday, December 28, 2026.
