Pursuant to the Hazardous Substance Cleanup Act (HSCA), 7 Del. C. § 9107 (a)(1), requires the Department of Natural Resources and Environmental Control (DNREC) to provide “public notification within 20 days after entering into negotiations for a voluntary cleanup settlement agreement with any person that agrees to perform a remedy.”
DNREC’s Remediation Section (DNREC-RS) is negotiating a VCP Agreement with Capano Management Company for the Worthington (site), located at Brenford Road and Rabbit Chase Lane, Smryna, Delaware. Identified by Kent County as tax parcel numbers 1-17-02810-01-0100-00001 through 1-17-02809-07-4200-0001, and 1-17-02809-07-98000-00001, the Site may have had a release of hazardous substances because of historical activities on site.
