Non-Discrimination Policy

The Department of Natural Resources and Environmental Control (DNREC) Remediation Section (RS) invites public comment on a proposal to clean-up Operable Unit 1 (OU-1) of the Riverwalk Phase I Site (DE-1731) (Site) located to the west of South Market Street adjacent to the Christina River in Wilmington. The approximately 1.36-acre OU-1 Site of the Riverwalk Phase I is part of Area 1 of the 86-acre proposed South Market Street Redevelopment Project (also referred to as the Riverfront East) located along the Christina River in downtown Wilmington. Historically, portions of the OU-1 were operated by multiple commercial and industrial businesses since the early 1900s, including: a tannery, bulk petroleum product terminal, filling stations, salvage yards, used pipe distributor, and other light manufacturers and wholesale distributors.

OU-1 will be subject to the following key remedial actions: the submittal of a Remedial Action Work Plan which specifies the methods to be used to remediate the site including the removal and disposal of the polychlorinated biphenyl (PCB)-impacted soil and arsenic-impacted soils to meet DNREC Hazardous Substance Cleanup Act (HSCA) and applicable Federal standards, implementation of a cap, development and compliance with the Contaminated Materials Management Plan (CMMP) and a Long-Term Stewardship (LTS) Plan, the recording of an Environmental Covenant restricting use to commercial, manufacturing, or industrial; limiting interference with remedy; limiting groundwater withdrawal; and compliance with the CMMP and LTS Plan; and the submittal of a Remedial Action Completion Report.
