The Department invites public comment on a proposal to clean-up Black Oak Development Site, OU-1 (DE-1863) located at 14241 Black Oak Drive in Lewes. The Site was historically used for agricultural purposes and consists of approximately 24 acres of a larger 77-acre parcel. The Site is divided into two operable units, OU-1 includes the shallow and deep soil. OU-2 includes the groundwater and soil gas. This Proposed Plan addresses OU-1. OU-2 will be addressed separately.
Black Oak Development Site, OU-1 will be subject to the following remedial actions: the submittal of a Remedial Action Work Plan (RAWP) which specifies the removal and disposal of arsenic-impacted soils to meet DNREC Hazardous Substance Cleanup Act (HSCA) residential standards, development and compliance with the Contaminated Materials Management Plan (CMMP), and the submittal of a Remedial Action Completion Report.
