Subaqueous Lands Permit Application

ASF MBTS, LLC (134-16.00-17.01) – To construct a road crossing by excavating 162 cubic yards of sediment and installing two (2) 36-inch diameter, 146 foot long culvert pipes with associated utility installation, and placing 910 cubic yards of fill and 8 cubic yards of rip-rap in an unnamed tributary to Beaverdam Creek, located adjacent to Summerwind Blvd., Millville by the Sea, Frankford, Sussex County, DE.

Sonia Spruill (1170190101070000) – To place 16 cubic yards of rip-rap along 60 linear feet of shoreline, and to construct a 4 by 15 foot long pier and 5 by 20 foot long dock in Lake Como at 72 Lydia Drive, Lake Como Woods, Smyrna, Kent County, DE.

Brian McGregor (334-19.00-230.00) – To remove an existing PWC lift with one (1) associated piling and install two (2) 5 by 14 foot long floating PWC docks and a 3 by 14 foot long floating walkway in Bald Eagle Creek at 131 East Side Drive, Rehoboth Beach Yacht and Country Club, Sussex County, DE

Margo Fitzpatrick (#334-19.00-326.00)To construct a 4 by 26 foot long pier, a 6 by 30 foot long dock, a 6 by 12 foot long floating dock, a boat lift with 4 associated pilings and a PWC lift with one associated piling in Bald Eagle Canal, at 87 Blackpool Road, RBYCC, Rehoboth Beach, Sussex County, DE.

John Collins (334-19.00-49.00) – To remove an existing structure and to construct a 4 by 15 foot long pier, a 6 by 30 foot long dock, a 6 by 12 foot long floating kayak dock and to install a PWC lift and a boatlift with four (4) associated piling.

SUEZ Water Delaware Inc. (0805600001 & 0901100066) – To maintenance dredge 1,250 cubic yards of sediment each year from White Clay Creek in the area surrounding two intake structures at the Stanton water treatment facility, 2000 First State Boulevard, Stanton, and dispose of the material at Parkway Gravel Inc., 820 Federal School Lane, New Castle, New Castle County, DE.

Subaqueous Lands Lease Application

Michael Baier (5-33-20.18-85.00) – To construct a 5 by 30 foot long dock and install a boat lift with four associated pilings in Assawoman Bay, at 38853 Tyler Avenue, Selbyville, Sussex County, DE.

Subaqueous Lands Lease Supplemental Application

Bay Pointe HOA (2-34-18.00-22.00) – To install a kayak launching system on the existing community pier in Herring Creek, Bay Pointe, Lewes, Sussex County, DE.

 Subaqueous Lands Permit and Wetlands Application

Delaware Department of Transportation (531-18.00-38.00) – To remove an existing 9 foot wide by 6 foot high, 64-foot long culvert pipe and install two (2) 60-inch diameter, 64 foot long culvert pipes, and to place 109 cubic yards of rip-rap, resulting in 437 square feet of temporary open water impacts, 1,631 square feet of permanent open water impacts, 174 square feet of temporary State-regulated wetlands impacts, and 311 square feet of permanent State-regulated wetland impacts in an unnamed tributary to the Nanticoke River, Woodland Church Road, Seaford, Sussex County, DE.

Delaware Department of Transportation (234-7.00-123.00) – To widen approximately 0.60 miles of SR 24, 0.35 miles of Angola Road/Robinsonville Road, and 0.17 miles of Camp Arrowhead Road/Fairfield Road, resulting in 1,282 square feet of temporary open water impacts, 784 square feet of permanent open water impacts, 1,098 square feet of temporary State-regulated wetlands impacts and 2,296 square feet of permanent State-regulated wetland impacts for culvert pipe installation and placement of new fill and rip-rap in and adjacent to an unnamed tributary to Love Creek and Sarah Run in Lewes, Sussex County, DE.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 20 days from this notice. Please indicate in your letter whether your intention is to request a public hearing or whether you are simply providing comments for the Department’s consideration. If a public hearing is desired, please be advised that a public hearing request shall be deemed meritorious if it exhibits familiarity with the application and provides a reasoned statement of the action’s probable impact.
