James Wayne Hutson & Carlotta Hutson (Tax # SM 119.00-01-02.00) have applied for a Rural Area Waiver (RAW) pursuant to Section 5.6.3 of The Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems. The request is being made to allow a system to be placed on land that does not meet current soil limiting zone criteria required by the Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems in Delaware.
The 15.30-acre parcel is located on the west side of Berrytown Road, south of Firetower Road, Camden-Wyoming, Delaware. The proposed on-site wastewater treatment and disposal system (OWTDS) is an elevated sand mound to be located along the west side of Berrytown Road. Advanced treatment meeting performance standard nitrogen level 3 (PSN3) is not being proposed as part of the OWTDS design. Section 5.6.3.1.5.6 requires that the proposed disposal location be located a minimum of 100 feet from all property boundaries, when soil conditions allow. The proposed disposal location will be located less than 100 feet from all property boundaries. Section 5.6.3.1.3 requires that the OWTDS serve only a single-family dwelling.

A public hearing on the above application will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 15 days from this notice. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
