The Department invites public comment on a proposal to clean-up Operable Unit 1 (OU-1) of 516 North King Street & Alico Road (DE-0371) located at 516 North King Street in Wilmington. The ±0.85-acre Site was administratively divided into two Operable Units (OUs) in April 2023 as a new area was amended to the Site after the majority of the Brownfield investigation activities had been completed. OU-1 consists of the majority of the Site (±0.72-acres) whereas OU-2 is about 0.13-acres of tax parcel 26-035.40-084 . The existing on-site building, referred to as the Customs House, was constructed in the mid-1800s for use as the U.S. Customs Department and U.S. Judiciary Department.
OU-1 will be subject to the following key remedial actions: the submittal of a Remedial Action Work Plan which specifies the methods to be used to remediate OU-1 including the design and installation of a passive vapor mitigation system of the existing and proposed new building; development and compliance with the Contaminated Materials Management Plan (CMMP); the recording of an Environmental Covenant restricting use to non-residential type and compliance with the Contaminated Materials Management Plan (CMMP) as well as the Long-Term Stewardship (LTS) Plan; completion of a CMMP and LTS Plan; abandonment and closure of on-site soil gas sampling points once no longer in use; and the submittal of a Remedial Action Completion Report.
