Pursuant to the Hazardous Substance Cleanup Act (HSCA), 7 Del. C. Chapter 91, §9126, the Department of Natural Resources and Environmental Control (DNREC) is required to issue a public notice within twenty days after entering into negotiations for Voluntary Cleanup Agreement (VCP). A VCP is an agreement between DNREC and a responsible party with respect to a site that sets forth a scope of work and schedule of remedial activities during the development of the Site.
As required by § 9107 (a)(1), DNREC advises that it has negotiated a Voluntary Cleanup Program (VCP) Agreement with the City of Dover regarding the Dover Power Plant, McKee Run Plant, Site (DE-0269) located at 880 Buttner Place, Dover, DE. The Site is identified as portions of Kent County tax parcel number 2-05-06711-01-0100.0001. The Site requires remedial action due to historic activities on site. For Site-specific information, please see DNREC’s Environmental Navigator at www.nav.dnrec.delaware.gov/DEN3.
The public comment period begins on Wednesday, March 23, 2022 and will end at the close of business on Tuesday, April 12, 2022. Please submit written comments to the DNREC-RS Project Manager, Rick Galloway at RS_Public_Comments@delaware.gov; or DNREC-RS, 391 Lukens Drive, New Castle, DE 19720. A copy of the VCP is available by accessing the DNREC-RS’ site files on the Delaware Environmental Navigator at den.dnrec.delaware.gov/.
