Pursuant to the Hazardous Substance Cleanup Act (HSCA), 7 Del. C. Chapter 91, §9126, the Department of Natural Resources and Environmental Control (DNREC) is required to issue a public notice within twenty days after entering into negotiations for a Brownfield Development Agreement (BDA). A BDA is an agreement between DNREC and a Brownfield developer with respect to a Certified Brownfield Site that sets forth a scope of work and schedule of remedial activities during the development of the Site.
DNREC’s Remediation Section (DNREC-RS) negotiated a BDA with 38 Bancroft Mills LLC regarding the 38 Bancroft Road Site, located at 38 Bancroft Road in Wilmington. Identified by New Castle County as tax parcel number 26-006.20-009, the Site may have had a release of hazardous substances as a result of historical activities on site. This Site is a portion of the Wilmington Piece Dye Site, (DE-1304), New Castle County tax parcel numbers 26- 006.20-041, 26-006.21-046 and 26-006.20-009, which DNREC certified as a Brownfield on August 21, 2008 to the Brownfield developer, Brandywine Partners, LLC. On March 15, 2021, DNREC certified a new developer, 38 Bancroft Mills LLC, who applied to be a certified brownfield developer for this portion of the site. Since 38 Bancroft Mills Road was originally designated as OU-3 of the Wilmington Piece Dye Site (DE-1304), but no investigation had been performed on this portion of the Site, DNREC determined that OU-3 of Site DE-1304 would now be designated as DNREC Site number DE-1758. The public comment period begins on Monday, April 5, 2021 and will end at the close of business on Monday, April 26, 2021.
