The Department of Natural Resources and Environmental Control – Remediation Section (“DNREC-RS”) invited public comment for a Brownfield Development Agreement (BDA) on Sunday, June 12, 2022. The notice was set to conclude on July 5, 2022. Due to the Section missing a publication for noticing, the DNREC-RS is extending the public comment period to July 7. Pursuant to the Hazardous Substance Cleanup Act (HSCA), 7 Del. C. Chapter 91, §9126, the DNREC-RS is required to issue a public notice within twenty days after entering into negotiations for a BDA. A BDA is an agreement between DNREC and a Brownfield developer with respect to a Certified Brownfield Site that sets forth a scope of work and schedule of remedial activities during the development of the Site.
DNREC’s Remediation Section (DNREC-RS) negotiated a BDA with the Riverfront Development Corporation regarding the Collins Property Site (Site), located at 519 South Market Street, Wilmington, Delaware. Identified by New Castle County as tax parcel number 26-049.00-012, the Site may have had a release of hazardous substances as a result of historical activities on site. The comment period was set to conclude on July 5, 2022. Due to the BDA missing a news publication for noticing, the DNREC-RS is extending the public comment period. DNREC is granting an extension of the public comment period beginning on Wednesday, June 15, 2022, and will end at the close of business on Thursday, July 7, 2022.
