Federal Consistency Certifications have been submitted to the Delaware Coastal Management Program for the following:

Delaware City Refining Company Maintenance Dredge (2021.0045)

The Delaware City Refining Company, LLC proposes to dredge the cooling water intake channel and access channel, twice per year, to a depth of 12 feet below mean low water (MLW), to dredge the navigation channel, once per year, to a previously-authorized depth of 37 feet below MLW, and to dredge the berthing area, once per year, to a previously-authorized depth of 40 feet below MLW. These activities would remove up to 12.5 million cubic yards of material from the Delaware River and adjacent channel during a 10-year period. Dredge material would be disposed in confined disposal facilities at the Delaware City Refinery, located at 1771 River Road and 22 Washington Street in Delaware City, New Castle County, DE.

River View Industrial Park LLC (2021.0050)

River View Industrial Park LLC is proposing to rectify the non-permitted placement of fill materials in emergent non-tidal wetlands by the previous land owner. This includes mechanically removing 1.12 acres of unauthorized fill material to original depths, removing and transporting the excavated materials offsite, and seeding and planting the excavated area with hydrophilic vegetation in order to restore the areas as emergent wetlands. Additionally, the applicant proposes to create an additional 0.56 acres of wetlands as a condition of an after-the-fact Nationwide Permit 39 issuance.
