Notice is hereby given that Delaware Health and Social Services (Herman Holloway Campus), having a facility at 1901 N. Dupont Highway, New Castle County, Delaware, has requested a federally enforceable 7 DE Admin. Code 1102 construction permit (Permit: APC-2025/0089-Construction/Operation (FE)) for one (1) emergency generator, rated 750 kW (1120 HP). The engine used in this generator set complies with U. S. EPA regulations under the provisions of 40 CFR 89, Non-Road Tier II emissions limits

Delaware Health and Social Services (Herman Holloway Campus) requests a limit for operating hours for the emergency generator. These limits are necessary to restrict Delaware Health and Social Services’ (Herman Holloway Campus) potential to emit air pollutants, and the limit will be enforceable by the EPA and the state. Total permitted emissions from the facility are 16.42 tons per year of NO_X, 12.29 tons per year of CO, 1.80 tons per year of VOCs, 0.16 tons per year of SO_X, and 1.16 tons per year of PM.

Upon completion of construction, the Department will incorporate the operating conditions and limits of the 7 DE Admin. Code 1102 Construction permit into the facility’s existing Synthetic Minor permit (APC-2019/0003-Construction/Operation (Amendment 01) via an Administrative Amendment.

The application, the draft permit, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft/proposed” permit may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. The “draft/proposed” construction permit is being submitted to EPA for concurrent processing. If there are no significant comments, the “draft/proposed” construction permit will be issued as a final permit after the expiration of the EPA review period.

A public hearing on the above application will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application within 30 days from the date of this notice, ending August 5, 2025. A request for a hearing shall be in writing. The request must also show a familiarity with the application and a reasoned statement of the permit’s probable impact.
