Non-Discrimination Policy

The Department of Natural Resources and Environmental Control (DNREC) Division of Watershed Stewardship Sediment and Stormwater Program has revised the Delaware National Pollutant Discharge Elimination System (NPDES) Construction General Permit (CGP). The CGP was previously authorized in March 2021, with an effective period of five years, and is to be reauthorized March 11, 2026. This document supports 7 DE Admin. Code 7201 Regulations Governing the Control of Water Pollution, Part 2 – Special Conditions for Stormwater Discharges From Construction Activities, and is in compliance with the Clean Water Act, 33.USC §1251 et. seq., and 40 CFR §123.1.

The Delaware NPDES CGP was publicly noticed on December 1, 2025. All comments have been considered, and changes are detailed in the Delaware NPDES CGP Fact Sheet. These documents are noticed in the February 2026 Register of Regulations and are available for review at dnrec.delaware.gov/watershed-stewardship/sediment-stormwater.

A public hearing on the revised permit will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the permit is received within 15 days from the notice in the Register of Regulations, a period ending February 16, 2026. A public hearing request shall be in writing, show familiarity with the permit, and provide a reasoned statement of the revised permit’s probable impact.
