Sarah & Purnell Potter IV (Tax # MN 168.00-01-06.01) have applied for a Rural Area Waiver (RAW) pursuant to Section 5.6.3 of The Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems. The request is being made to allow a system to be placed on land that does not meet current soil limiting zone criteria required by the Regulations Governing the Design, Installation and Operation of On- Site Wastewater Treatment and Disposal Systems in Delaware. The 13.78-acre parcel is located on the east side of Sugar Stick Road, east of Murffs Road, Harrington, Delaware. The proposed on-site wastewater treatment and disposal system (OWTDS) is a sand lined elevated sand mound with advanced treatment meeting performance standard nitrogen level 3 (PSN3). Section 5.6.3.1.5.6 requires that the proposed disposal location be a minimum of 100 feet from all property boundaries (when soil conditions allow). Section 5.6.3.1.3 requires that the OWTDS serve only a single-family dwelling.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 15 days from this notice.

A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
