DNREC Regulations

The regulations that govern the Department of Natural Resources and Environmental Control (DNREC) are published by the Office of the Registrar of Regulations as part of the Delaware Administrative Code.

DNREC follows an internal regulatory development process to ensure full communication, openness and predictability in developing, adopting, amending, and/or repealing regulations. It follows all legal and programmatic requirements.

Regulatory changes begin with a Start Action Notice (SAN) which lists the type and purpose of the proposed change, the statutory basis for the action, affected stakeholders, schedules and more information.

Proposed changes are published in the monthly Register of Regulations and as DNREC public notices in statewide newspapers. DNREC public meetings and events, including Public Hearings, are published on the DNREC calendar of events. Meetings subject to the state open meetings law are also published on the state Public Meeting Calendar.

Regulations Under Development

The Division of Air Quality and the Division of Waste and Hazardous Substances both maintain web pages that provide more detail on proposed regulatory changes.
