Kent County Levy Court’s existing agricultural utilization (AGU) permit authorizes the land application of treated biosolids (Class B) generated at the Kent County Regional Resource Recovery Facility onto four farms, located in Kent County Delaware, known as the Kent County Sludge Farm, the Blessing Farm, the Goldinger Farm, and the West Farm. Prior to land application, the biosolids are required to undergo periodic analysis for a list of specific parameters including nutrient content and metals. Biosolids are required to be delivered to the land application sites in accordance with a valid waste transporters permit where the material is permitted to be land applied at agronomic rates.
Kent County has submitted a permit application requesting the removal of the Nyle Calloway Farm from the AGU permit and requested renewal of the aforementioned AGU permit for the land application of treated biosolids onto the remaining land application farms.
Kent County Levy Court’s existing distribution and marking (DM) permit authorizes the application of biosolids, which have been lime stabilized and thermally pasteurized or heat dried, generated at the Kent County Regional Resource Recovery Facility (located near Frederica Delaware) onto farmland as a fertilizer and a liming agent. To assure compliance with State and Federal regulatory requirements, including requirements for “Class A” “Exceptional Quality” biosolids products, the finished product is sampled for specific bacterial, chemical, and nutrient parameters prior to distribution. In accordance with the DM permit, the land application of biosolids may be made onto land at a rate to adjust the soil pH as determined by an approved soil test and to provide nutrients for crop growth at an agronomic rate in accordance with a nutrient management plan. The “Kentorganite” product is permitted to be utilized in agricultural settings and on athletic fields, golf courses, roadside grass strips, and other similar grassy areas.
Kent County has submitted a permit application requesting the renewal of their existing DM permit to continue to produce, distribute, and market their biosolids product known as “Kentorganite.”
Renewal of the above referenced permits will occur in accordance with requirements in Part III, B. of the Department’s Guidance and Regulations Governing the Land Treatment of Wastes which allows for such activity pending public notice.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application(s) is received by 4:30p.m. May 21, 2019. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
