Public Hearing: Proposed Amendments to Delaware Air Regulations

The Department of Natural Resources and Environmental Control (DNREC) will conduct a public hearing (Docket # 2021-R-A-0009 through 0011) on proposed amendments to Delaware air regulations. The hearing will address:

  • Amendment to 7 DE Admin. Code 1102 “Permits” regarding public notice publication requirements for general permits to maintain consistency with the wording of the Environmental Protection Agency’s (EPA) current federal regulations.
  • Amendments to 7 DE Admin. Code 1103 “Ambient Air Quality Standards” to update the National Ambient Air Quality Standards (NAAQS) for ground level ozone and the Code of Federal Regulations (CFR) reference dates for all NAAQS, and to remove the SO2 24-hour and annual primary standard to maintain consistency with EPA’s current federal regulations.
  • Amendments to 7 DE Admin. Code 1130 “Title V State Operating Permit Program” to update the public notice publication requirements, affirmative defense requirements, and list of greenhouse gases (GHGs) and their global warming potential (GWP) values to maintain consistency with EPA’s current federal regulations.

Those wishing to offer verbal comments during DNREC public hearings must pre-register no later than noon of the date of the virtual hearing at de.gov/dnreccomments or by telephone at 302-739-9295.
